Public Attacks Against the Victorian Judiciary Are Unfounded and Dangerous
ICJ Victoria has previously deplored the public attacks made by politicians against the character and independence of judges and magistrates in Victoria. It is unfortunate that such attacks are continuing to occur.
The comments made in recent days by a senior Cabinet Minister not only reveal a blatant misunderstanding of the judicial process, but also seek to undermine public confidence in the legal system. Further, they threaten the judges’ independence, who are unable to respond to the slurs made against them.
It is important to remember that judicial independence exists to serve the people. Ours is a society which relies on the operation of the rule of law. To ensure that everyone is treated equally under the law, the independence of judges must be respected.
No person is above the law, and politicians should not believe that they are any different.
